Article: New York Passes Strangulation Law

Man arrested for alleged strangulation posts bail

HYDE PARK — A 20-year-old man arrested Thursday under the state's new stragulation law has posted bail.

The man was sent to Dutchess County Jail on $1,500 cash bail or $2,500 bond and scheduled to appear in Town of Hyde Park Court at a later date.

He was released Thursday at 11:46 a.m., according to jail officials.

Police arrested the man today following a domestic dispute in which he allegedly strangled his four-month pregnant girlfriend.

The incident triggered charges under the state’s new strangulation law, which went into effect on Nov. 11.

The Hyde Park man was charged with criminal obstruction of breathing or blood circulation, second degree unlawful imprisonment and third degree attempted assault, all misdemeanors.

Police responded to the scene at 8:53 a.m. after being contacted by one of the woman’s friends. The woman told police she was strangled, hit throughout the night and prevented from leaving the apartment.

The law, which was signed into legislation in August, defines strangulation as the intentional obstruction of a person’s breathing or circulation, making it a crime to choke or strangle without signs of injury and establishing first and second degree strangulation resulting in physical injury as felonies.

The Journal does not typically print the names of individuals charged with misdemeanors.
